Agreement to Terms
By accessing and using Encbyt, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Use License
Encbyt grants you a limited license to use this service for personal, non-commercial use, subject to the restrictions that follow. You are not permitted to:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display
- Attempt to decompile or reverse engineer any software contained on Encbyt
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
- Violate any applicable laws or regulations
Free Trial Terms
Encbyt offers a free trial period of 30 days with 5 GB of storage. At the end of your trial:
- Your account will be paused, but files will not be deleted
- You may upgrade to a paid plan at any time to regain access
- If unpaid after 90 days, files may be permanently deleted
User Content
Your Responsibility
You are responsible for any content you upload to Encbyt. You warrant that:
- You own or have the right to use all content you upload
- Content does not violate any laws or third-party rights
- Content does not contain malware or viruses
- Content is not illegal, hateful, or abusive
Content Rights
Encbyt does not own content you upload. You retain all rights to your files. However, by using Encbyt, you grant us a limited license to:
- Store and backup your encrypted files
- Perform technical operations necessary to provide the service
- Comply with legal requests regarding your account
Limitations of Liability
Disclaimer
The materials on Encbyt are provided on an 'as is' basis. Encbyt makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Limitation of Liability
In no event shall Encbyt or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Encbyt, even if Encbyt or an authorized representative has been notified orally or in writing of the possibility of such damage.
Service Availability
While we strive to maintain 99.9% uptime, we do not guarantee that:
- The service will be uninterrupted or error-free
- Any errors will be corrected
- The service will meet your specific requirements
Data Loss
Encbyt maintains regular backups of encrypted data. However, we are not liable for any data loss resulting from:
- Your failure to maintain password security
- Deletion or modification by you or unauthorized third parties
- Natural disasters or circumstances beyond our reasonable control
Modifications to Terms
Encbyt may revise these terms of service for our service at any time without notice. By using this service, you are agreeing to be bound by the then current version of these terms of service.
We will notify you of material changes via email or in-app notification. If you do not agree to the updated terms, you may close your account.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of India, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
Dispute Resolution
In the event of any dispute arising out of these Terms, the parties agree to attempt to resolve the dispute through good faith negotiation before pursuing legal action.
